DUI AND DRIVER’S LICENSE REINSTATEMENT: THE WHAT’S AND HOW’S

Basically, you are requesting the court to allow you to drive while your case is pending under limited circumstances. In general, the officer is required by law to immediately forward a copy of the completed notice of suspension or revocation form and any driver license taken into possession, with a sworn report to the DUI. The DUI ticket automatically conducts an administrative review that includes an examination of the officer's report, the suspension or revocation order, and any test results. If the suspension or revocation is upheld during the administrative review, you may request a hearing for a driver’s license reinstatement.

How can it affect you?
It can affect you daily or not at all. For example, a resident who has their license suspended and can use public transportation instead has less to worry about than someone who commutes to work or travels regularly.

What are the hearing procedures?
In order to obtain a formal driver’s license reinstatement hearing, you must make a written request to the state. About 14 days after you make your request, the state will mail you a hearing notice, advising you of the time and date of your hearing.

How can a lawyer help?
Due to the different circumstances in every driver’s license reinstatement case, and to the varying laws in different states, the possible consequences of a DUI are dependent on many different factors. An experienced lawyer can help you understand the potential fines or jail time that may be a consequence in your state should your case go to trial.

Some other things to remember…
In driver’s license reinstatement, always remember to make sure that the department of licensing has your current mailing address because the holder must notify the department of licensing in your area in writing of a new address with 10 days of moving. Make sure that when concerns in driver’s license reinstatement is needed, always correspond in writing.

Many DUI lawyers only deal with driver’s license reinstatement and know the process inside and out, including hidden options that a public defender may not tell you. So when faced with a DUI charge, hiring a traffic lawyer is the best option.
