CHOOSING A TRAFFIC LAWYER FOR YOUR DUI DEFENSE

Just as every person is unique, so are the details of every person’s own DUI arrest circumstances. When searching the internet about DUI defenses and laws, you will certainly come across many websites and even some traffic lawyer pages offering what seems to be a quick-fix solution on how to beat a DUI case. What you need to know is that nearly all of these types of sites are simply selling general information on DUI charges. The reality is in DUI defense, you already are very much aware that you will be facing legal expenses while fighting your DUI arrest. The last thing you need is to waste money unnecessarily on generic information or services sold online, and isn’t even about your individual case.

Learn How the Traffic Lawyer Can Help

Traffic lawyers can listen to the details of your situation and analyze your legal position and give you the pros and cons of alternate courses of action. Most attorneys have a pretty good relationship with prosecutors. They know their way around the court system and will use their expertise to your advantage.

Do a Background Check

Another important item to check is the traffic lawyer’s background. Did he or she graduate from a quality law school? Were they on Law Review? Have they won any awards? Did they previously work at a court and/or large law firm? The more impressive the traffic lawyer’s background the better. Be wary of a traffic lawyer who does not set forth his or her education and prior experience. It is safe to assume that in such cases the traffic lawyer’s background is less than impressive.

Make Sure He/She Has Good Court Experiences

A lengthy traffic trial resume indicates that the traffic lawyer has no qualms about appearing before a judge or jury on your behalf; but the opposite may imply that a traffic lawyer will just try to dispose of your speeding ticket and ignore your DUI defense as quickly as possible. In the land of traffic lawyers, trial experience is generally what separates orators, debaters, and advocates from the desk jockeys and paper-pushers.

WHY CHOOSE A TRAFFIC ATTORNEY FOR YOUR DUI DEFENSE?

Be smart! Your choices made during a DUI defense case or drunk driving investigation will have long-term and costly consequences for at least 10 years. There are decisions and steps you can make to win or lessen your dui case, or at the very least reduce your court and DMV penalties.

Why hire a traffic attorney?

At first glance, hiring a traffic attorney for a normal traffic ticket may seem like a waste of money. However, traffic attorneys play a huge role in keeping you out of trouble in court since the results affect a lot in your career and other insurance needs. Your driving record is perhaps the biggest factor car insurance companies use to determine the price of your car insurance premium. Blemishes in your driving record, including crashes and traffic violation convictions, can negatively affect your rates. Also, paying a traffic violation is not just about the fine involved. Admitting guilt for a traffic offense can increase traffic violation points, leading to a suspended license.

What are the types of traffic attorneys?

There are two types of traffic attorneys: public and private. Their job description is basically the same: they specialize in traffic offenses, and know the players, the ever-changing laws, and the processes by which cases are resolved in local traffic courts. Prosecutors often take advantage of people who aren’t represented by legal counsel. An experienced traffic attorney works to obtain the best possible outcome for your DUI defense. Their goal is to get the citation dismissed or at least reduced to a non-moving violation. The main difference between the two is the fee. If an individual believes that he or she cannot afford an attorney, that person may request the court to appoint a traffic attorney from the Public Defender’s Office. Court-appointed traffic attorneys represent only indigent people facing a jail sentence. Financial hardship caused by hiring an attorney is not sufficient grounds for the appointment of an attorney.

Once you have chosen a traffic attorney, consult with him, so that you understand the charges filed against you. If you are charged with serious offenses, you must have a DUI defense attorney representing you to the court.

DUI DEFENSE THROUGH A DUI ATTORNEY

If you’ve been charged with DUI or driving under the influence, you have every right to hire a DUI lawyer. However, the question to ask is, should you hire or not hire one? Hiring a drunk driving case attorney can be a huge expense, which will make you think twice. But more often than not, it is crucial that you hire a lawyer and a right one at that. Here are some reasons why:

1.       Driving under the influence or DUI is considered a serious offense. Not only are you putting yourself in harm’s way, but you have become a risk to others too. And law enforcers wouldn’t want you anywhere I the streets. If you’re slapped with a DUI case, this will affect your current job and maybe, your future employment. Whether it’s your first time to be caught for DUI or not, you need a good DUI lawyer to represent you.

2.       DUI laws have changed significantly. Back then, you can just plead to a lesser charge and pay a fine. But when the 50 states passed the new DUI law, punishing all intoxicated drivers have become mandatory. The DUI law states that if a driver’s blood alcohol content is above .08, the driver is already guilty of DUI. This can be measured through a blood or breath test. This is the single, most effective evidence to prove that a driver is guilty of driving under the influence.

3.       The need for a DUI lawyer doesn’t just arise from the need to claim your innocence (if you really are), you have to be represented in the court of law properly. For one, if you failed the sobriety test, your license will be suspended or confiscated on the spot. Next, you will have to be present in court hearings to discuss if you are indeed guilty or not. Without any knowledge of such offenses, going to a court without a lawyer is like going to war without ammo.

4.       If you are indeed innocent, the more you need to hire a DUI lawyer. He will be the only one to prove that in court. But for the most part, your lawyer will help you through the extensive process like what is expected of you, the requirements needed, getting your license back and perhaps, some professional help on alcoholism too.

In A DUI offense, you’d really want to restore your driving privileges as quickly as possible but you can only do this with a lawyer at your side. To hire or not to hire a lawyer? You definitely should but choose one that is experienced in defending DUI cases.
