Do
drivers need an attorney when they are charged with driving under influence? The
simple answer is it depends. The truth is, the need for a traffic attorney will
depend on the depth of the charge.
If
you are guilty of driving under influence and you are charged, you can get an
attorney or not. In 41 states, traffic officers are now allowed to get our
license and suspend your driving privileges. If this happens and you know that
you are guilty, you can go to court yourself without any representation and
just accept the punishment.
However,
it is a totally different case if you happen to injure someone or put another
person in harm’s way. In this case, you will definitely need a traffic attorney.
When you are charged with driving under influence plus causing harm and injury
to others, the sanctions will be more severe. The fees will be higher, the
charge will be heavier and its effect on your life will be bigger.
In
this case, a traffic attorney can defend your case in court. If you plead
guilty, the lawyer can still try to ask the judge to reduce the penalty and
punishment. Your lawyer will negotiate on your behalf and this is something you
can’t do alone.
Now,
another case is if you are wrongfully charged. You were clean when you got
caught. But still, the traffic officer charged you with driving under influence.
Here, you also need a good traffic attorney to help you out.
The
attorney will take care of building a defense case for you. He will look for
evidence to prove that you are innocent. He will try and search for
eyewitnesses and even look through CCTV and surveillance footages just to prove
that you are wrongfully charged. Only an experienced and skilled attorney can
do this for you.
To
avoid this kind of trouble, the solution is really simple: stop drinking and
driving. There’s really no escape if you get caught. All traffic officers carry
breath analyzers with them. If they suspect that you’ve been drinking, they’ll
test your breath. If the blood-alcohol content is at 0.08 or above, you are
guilty. There’s no need to make you walk in a straight line or even answer
questions, you will get arrested right then and there.
A
traffic attorney will do his best to get you out of trouble. Hiring a lawyer
may be expensive, but this is the price to pay when drivers break the law. On
that note, make sure you hire a good lawyer to help you as well.
