Driving while License is Suspended: Help from Traffic Attorney

More and more drivers are retaining traffic attorneys when they receive a traffic ticket. In addition to receiving professional advice from an experienced attorney, motorists are happy to delegate this task and avoid wasting time in court themselves. One of the cases they ask help from traffic attorneys is driving while license is suspended. Considered as serious traffic offense, driving while license is suspended means that the police have caught you driving without a valid driver’s license. Your license would have been suspended by the court, police or the sheriff. If the police charge you with an offence of ‘driving while license is suspended’ you will get a charge sheet. Look at the details of the ticket to see what the police officer wrote about your offence. The magistrate refers to this in the courtroom.

Before hiring a traffic attorney, it is important that you assess them using these important points:

·      Experiences. Find out how many traffic court cases the lawyer has handled and learn what types of violations the lawyer has been successful in handling. What results have been obtained and what percentage of cases have been won or successfully plea bargained? You have a right to know the answers to these questions. More specifically, you need to determine how much experience a traffic attorney has in representing defendants who have been charged with driving while license is suspended. If they give you an evasive answer, ask them about some of the common technical and legal defenses used when fighting these charges.

·         Background. Another important item to check is the traffic attorney’s background. Did he or she graduate from a quality law school? Were they on Law Review? Have they won any awards? Did they previously work at a court and/or large law firm? The more impressive the traffic attorney’s background, the better. Be wary of an attorney who does not set forth his or her education and prior experience. It is safe to assume that in such cases the attorney’s background is less than impressive.

·         Communication and competence. A competent and honest traffic attorney will ask whether it even makes sense for you to fight an offense of driving while license is suspended. For example, if the ticket carries no points or you have an out-of-state license and points do not transfer. Under such circumstances, hiring a traffic attorney likely is not worthwhile.

Good Traffic attorneys work tirelessly to get your ticket dismissed or reduced to a lesser charge that comes with fewer (or no) points, cheaper fees and more.
