There is a big number of
undocumented workers in the U.S. right now, particularly in the state of
California. Just like any other worker, these people just want to earn a
living.
Most of them work physical labor
jobs because an undocumented worker is not given the same opportunity as legal
citizens. Because of this, undocumented citizens aren’t given the same rights
and benefits too, like workers’ compensation. If they get injured, it will be a
challenge to get compensation for their medical bills.
For an undocumented worker, the
denial of workers’ compensation is considered injustice. They work as hard every
day and are even more at risk because of their physical labor jobs. So, the
best way to protect oneself against such injustice is to talk to an attorney
who are qualified in handling such cases.
But wait, do undocumented workers
have the right to workers’ compensation according to the law? In California,
the Immigration Reform and Control Act of 1986 says that it is unlawful to hire
an undocumented immigrant. However, many businesses in California do not follow
this law and continue to hire undocumented workers because of their lower pay.
As a result, California has
already defined the rights of undocumented employees. As for their workers’
compensation, an undocumented worker is covered in terms of medical bills.
What’s unclear is the compensation for job training, lost wages, and other
types of benefits.
If they are covered, then what is
the problem? One possible problem is the company the undocumented employee is
working for. That company may not allow the worker to exercise his or her
rights. The next problem is that even if undocumented workers qualify for
workers’ compensation, the claiming process takes a long time. The worker will
have to wait a while before he or she can finally receive the compensation. And
the undocumented worker might not even have enough time to get the proper
medical care needed before they are forced to go back to their country.
Undocumented workers should have
the same legal rights as any other worker. That’s because they put in the same
time, work and effort into their work. They shouldn’t be cheated out of the
